The Rights at Work legislation was introduced in 1999 to ensure that workers are paid for the normal working week. This includes the right to paid annual leave and paid sick leave. This means you should be entitled to 46 days of paid annual leave and, in the most severe case, to an extra 56 days of paid sick leave.
These rights are administered by a special statutory authority known as the Department of Enterprise, Trade and Investment (DETI). It is up to the DETI to negotiate agreements with employers.
However, it is possible for a worker to sue in the High Court for the breach of their employment conditions. These are grounds for a claim for wages and unpaid annual leave.
Employers must notify the DETI 30 days before implementing pay cuts or flexible working arrangements. They must also provide a reason for the change.
If you are asked to move to a new city after you have taken a paid leave, the law does not apply to the relocation. However, you may be entitled to a relocation allowance, if your employer has failed to take reasonable steps to relocate you.
There are three types of relocation allowance available. These are:
a relocation allowance
the costs of living allowance
an additional amount for losses of earnings.
These allowances are recoverable if the employer has failed to take reasonable steps to relocate you after you have put in your request, within 30 days.
The calculation of the allowance is complicated. An employee will have to prove that the reason for the relocation is attributable to the employer’s breach of its duties.
The ‘relocation allowance’ is similar to a relocation payment, but the concept of ‘removal’ refers to a move to a new job. It does not include a move to a new location within a company or to a different company.
